Transparency Act

The Atlantic City Transparency Act is a step in the process of making government more transparent. This division of the Clerk's webpage is not a traditional division of government as it has no budget and no personnel assigned. The members of the City Clerk's staff will post information to this Division page relating to public contracts, grants, and salaries of employees (by job title) as a way to aggregate this information. These documents can also be search in the main document library of this site.

AN ORDINANCE AMENDING SECTION 18-6 OF THE CITY CODE OF
ATLANTIC CITY TO BE TITLED AS THE ATLANTIC CITY TRANSPARENCY ACT

WHEREAS, it is the right of the citizens of Atlantic City to know how and where their tax money is being spent; and

WHEREAS, while the Open Public Records Act (OPRA) law is a great tool for citizens, it is a passive model wherein a citizen has to request information before it is released; and

WHEREAS, in this era of easy internet access, government has a duty to transition toward an active model of public information disclosure using technology to establish greater levels of transparency and collaboration with citizens, informed by easier access to public data, in order for the government to work better with citizens in crafting solutions to the pressing issues of our time,

NOW, THEREFORE, BE IT ORDAINED by the Council for the City of Atlantic City that the City of Atlantic City shall inact the “Atlantic City Transparency Act” as a step, rather than an end, in making government more transparent, which should be a continual aim of this governing body. This act shall state the following:

SECTION 1: There shall be added a Subsection C to Section 18 of the City Code entitled “Public Records” as follows:

C. The City of Atlantic City shall publish the following information on its website:

(i) All public contracts wherein the City has contracted with any entity for Goods and Services, including Professional Services,

(ii) All grant receipt documentation setting forth the conditions under which grants were received and the amount of the grant,

(iii) Salaries of all employees of the City of Atlantic City, to be listed by job title.

SECTION 2: All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance are hereby repealed to the extent necessary to remedy the inconsistency.
SECTION 3. This Ordinance shall become effective upon final passage and publication as provided by law.
